Criminal Aliens Are Not a Deportation Priority under Obama Immigration Solution

While political “Conservatives” may have heated debates with political “Liberals” on a host of issues, both sides of the political spectrum certainly should agree that one of the noncontroversial missions for our government is to provide for national security and public safety. This is based on our Constitution and common sense.

Our nation’s borders and immigration laws are America’s first line of defense against international terrorists, enemy combatants, transnational criminals and enemy nations that would seek to enable their spies and saboteurs to enter our country.

While there may be debates about the role of government in creating jobs, what is almost always ignored in those debates is the role of government in making certain that only Americans and lawfully admitted permanent resident aliens are given first shot at the jobs. Politicians seeking public office always promise to create jobs, yet few if any of these politicians talk about the necessity of liberating jobs through the effective enforcement of our nation’s immigration laws.

On November 22, 2014, the Washington Examiner published an article, “Drunk drivers, sex abusers, drug and gun offenders not top deportation priorities,” that made it abundantly clear that the administration couldn’t care less about providing opportunities for American workers and addressing public safety concerns with effective enforcement efforts.

This report began with the following paragraph:

The Department of Homeland Security has just released new “Policies for the Apprehension, Detention, and Removal of Undocumented Immigrants.” Designed to fill in the details after President Obama’s announcement that at least four million currently illegal immigrants will be given work permits, Social Security numbers and protection from deportation, the DHS guidelines are instructions for the nation’s immigration and border security officers as they administer the president’s directive.

Clearly, law enforcement agencies have to marshal limited resources to get the “most bang for the buck.” The use of appropriate prosecutorial discretion strategies is a legitimate way of addressing the limited resources that law enforcement agencies have to combat crime within their jurisdictions. An example of such a use of prosecutorial discretion is the police officer who ignores a driver who exceeds highway speed limit by a few miles an hour, provided that the driver is driving safely.

For years, President Obama claimed that not seeking to arrest and deport (remove) aliens who have not been convicted of committing serious crimes constituted an appropriate use of prosecutorial discretion. The reality is that our immigration laws and our borders are vital to national security and public safety. Aliens who evade the inspections process or commit visa fraud or defraud the immigration benefits program may well pose a serious threat to national security.  This was an issue addressed by the 9/11 Commission.

A reasonable strategy to make effective use of limited resources should dictate that deportable aliens who are encountered during the course of other immigration investigations be taken into custody and deported even if they have no convictions for serious crimes, adding the element of “randomness” to the enforcement toolbox. This would send a clear message to aspiring illegal aliens around the world that the United States takes its borders and its laws, all of its laws, seriously.

With the implementation of the massive DACA (Deferred Action for Childhood Arrival) program for “DREAMERS” (supposed alien children who entered the U.S. as teenagers – but who could be as old as age 31 to apply for such benefit), DHS dedicated resources to not simply ignore these hundreds of thousands of illegal aliens but to provide them with lawful status and official identity documents. Thus, through this program, a clear message is being broadcast to aspiring illegal aliens from around the world that the administration and many politicians are happy for them to enter our country – no matter how they get here.

Further, because of the huge number of aliens who applied for DACA, neither face-to-face interviews nor meaningful field investigations were conducted. This violates not only good judgment but the findings of the 9/11 Commission.

Now, with the last election the administration will face behind it, Obama has taken his gloves off and upped the ante; he is now preparing to provide millions of illegal aliens with identity documents, Social Security Cards and temporary lawful status. There will be no interviews, and aliens who have been arrested for various serious crimes will also be shielded from deportation.

While it has been estimated that this program might involve 5 million aliens, the ultimate number may well be much, much greater. The Reagan Amnesty of 1986 was supposed to involve roughly one million illegal aliens. By the time the bureaucratic dust had settled, 2.7 million aliens had been granted lawful status.

Obama’s plan will profoundly impact the general public as the population of criminal aliens living in towns and cities around the U.S. – especially in ethnic immigrant communities – will increase greatly. The residents of these communities will be at the greatest risk of falling victim to alien criminals who should have been removed from our country, if not for an administration who shields them from deportation.

Many jails are optimistically referred to as “Correctional Facilities.” There is great concern about the threats posed to public safety by recidivists, criminals who are no sooner released from prison than they return to their lives of crime and become repeat offenders, victimizing still more innocent victims. With criminal aliens there is a practical and effective strategy – deportation (removal).

Meanwhile, aliens engaged in terrorism or other acts that would compromise national security, and who have entered the U.S. and maintain a low profile until they are called into action (“sleepers”), are far less likely to be detected as a result of Obama’s program.

While many discussions about immigration center on compassion, it is time that concerns about compassion be focused on the beleaguered citizens of the United States
